Subject of the Reglament  

This Reglament determines the procedure and conditions of technical support of Just-Write software products (hereinafter the Software) and regulates the relations between JustWrite™ and the Licensee.

This Reglament is a part of an offer of JustWrite™, the other part of which – a proposal for making a license agreement granting the right to use the Software – is also placed on the Web-site of Just-Write™ at http://www.bartcharts.com/software_license_agreement.htm .

Scope and Conditions of Technical Support  

Technical support of the Software includes:

Software updates distributed periodically in order to eliminate detected errors, improve performance, or broaden the functionality of the Software;

Technical Support of the Licensee including consulting with respect to installation, troubleshooting, and use of the Software;

Installation of the Software to the server;

Update of the Software  

Loading and installation of Software updates is performed automatically provided the server, on which a copy of the Software is installed, is connected to the Internet, has an IP address accessible by Just-Write technical support specialists, and has a valid Maintenance agreement.

Updates are available during the entire period of the Software use chosen by the Licensee when ordering the Software and Maintenance.

Technical Support  

Technical support of the Licensee consists of consulting with respect to installation, troubleshooting, and use of the Software and the digital pens used by the Software.

Technical support does not include troubleshooting of the servers, computers, or printers on which a copy of the Software is installed or executed.

Technical support does not include troubleshooting of the HL7 interface beyond verification that the Software is operating properly.

Technical support does not include custom development requested by the Licensee in regards to the Software functionality or development of a unique interface between the Software and the Licensee’s medical record system.

Technical support is provided by Just-Write™ specialists and is rendered during the entire period of the Software use chosen by the Licensee when ordering the Software and Maintenance.  For the purposes of this clause, the beginning of the Software use is the point of installation on the Licensee server.

Technical support of the Licensee is rendered without additional fee when performed by Just-Write™ specialists.

Installation of the Software to the Server  

When a license is ordered, Just-Write™ specialists will be assigned to install the Software to the server provided by the Licensee.

To enable Just-Write™ specialists to install the Software to the server the Licensee shall specify the root password for access to the server. The Licensee shall also refrain from any actions that can interfere with execution of these works, and, if necessary, render the required assistance to Just-Write™ specialists.

As part of the installation process, the Licensee will allow Just-Write™ to install all necessary third party products and drivers required by the Software to function properly.  This includes, but is not limited to, the software required by the digital pens.

The Licensee agrees to provide an HL7 interface from the Licensee’s medical record system in order to provide patient information to the Software.  Just-Write™ specialists will work with the Licensee during installation to ensure proper operation of the HL7 interface.
